The only way an HOA can oppose something is if the property in question is part of the retail/business HOA. For example the retail areas of Summerwood are governed by deed restrictions set in place by the retail branch of the HOA. They are not the same organization, but they consult one another. This is why the buildings and plantings look similar.
 
I would have to guess that this undeveloped land is privately owned as it doesn't contain any neighborhood "for sale " signage like the empty lots in Summerwood/Eagle Springs etc do....and as @fairlane67, said there is no zoning in the area so no one really has a say in what a private party wishes to do with their land.
 
I will add that I am sympathetic to the concerns of the neighborhood. It's sad to see the trees go and I'm sure it is a shock to find out that this buffer wasn't actually a planned green belt for the neighborhood.

I will be thrilled to have a movie theater there . I just bet the people in Kingwood will be happy for us to stay here instead of at the one near them . Some of them will come here but this will be much closer for Huffman to come to .

I would love an Alamo Drafthouse, maybe not right there though. It does seem like a strange place for a theater. They play a lot of anime movies which my daughter loves. And the closest one since they closed the one on Louetta is in Katy.

Where are 4 theaters in this area? Isn't Humble about 10 or so miles from the Lake ? The theater near kingwood is further than that .

@ Fairlane 67 that location is hardly the middle of the subdivision The Overlook is much closer to be in the center of the subdivision . Please go look at the plat on page 1 it says The Overlook entertains over 30,000 guest a year . Corporate events , social events , weddings ! Wonder if anyone leaves there drunk & drives on our streets . Then that doesn't even include all the golfers which are I'm sure many many more .
 
Atascocita 1 apartments back up to houses .The Pines ,apartments & business back up to houses . 12th fairway church & business back up to houses . Pinehurst Section 8 HEB , Lowes & others back up to houses . Other side of Pinehurst Section 8 The nursing home & businesses back up to houses .
 
Was anyone upset about all those homes that have apartments & businesses behind them ????

A theater alone can do that in half a year, or less. There's still nowhere near the amount of vehicle traffic for The Overlook, on a daily basis there, that something like this would draw. The lighting there is quite subdued, bordering on barely perceptible. Quite different from what a retail center, with a theater that would be open until late at night, would expose to the local environment.

Maybe they should have been. Maybe they were but didn't do anything about it. This is how zoning ordinances end up with no teeth to them. This is how things fly through under the radar until one day more acreage is being plowed under. More of everything is not necessary.

I'm not arguing I'm simply pointing out the facts that business are not something new to ACIA .And I could care less if the overlook has 20,000 LESS cars than what this movie theater will have .
 
@ Analogkid did I say are suggest you shouldn't do something about this ???? Go knock yourself out if you want . Unless Trump changes it this is still America !

Anything but Burlington, Ross, mattress store, dentist office, insurance office, donut place, nail salon would be great. Maybe they can move the GameStop, nail place, shoe and beauty place by existing HEB and make the HEB bigger, that would be really great!

I'm trying to figure out what exactly your argument would be to stop this from happening ??? You know if a good restaurant went in there next to this theater that produces a bunch more tax dollars then some trees .
