@Greg Until someone's kid get's hit by a car and injured and sues the driver and YOUR Community Association for condoning the activity...

Completely not my original point of this thread- but at that point where does it stop? Couldn't it then be the same as one suing over child getting hurt at BB goal at pool? Or even hurt at the community pool? Or if speed limit isn't followed and child was hit when we have police paid to watch neighborhood? Or me jogging and tripping over crack in sidewalk? Correct me if I'm wrong - but a lot of stupid crap w all the sue happy people now days could be used for most neighborhoods.

Thanks Tuckersmom... Your are right on all of that and I agree. Still... asking the HOA to condone playing basketball in the street is not right. Sheltie_Momma... it was voted on several years ago... thus the current policy which still stands.

@Tuckersmom You seem to be absolutely certain that none of the other homes have received letters for basketball goals. How do you know this to be a fact? You stated that this is one of the two reasons that you are so mad.

@Sammee I don't know for certain they didn't receive letters. I know the officer that knocked on my door wasn't going to others houses that day. My point was that if they come & take this goal they need to take all other 8 goals obviously illegal with them too. My upset in the beginning was that this goal was deemed my property and it wasn't mine. I don't care what actually happens to it- I just didn't want to get in trouble or fined for something that's never been mine and thought police at my door was excessive!

Look on Google Maps Street view and see if the goal is there. Then ask Google what date the photo was taken. If it was prior to your house purchase, then that should be good proof for them.
 
If you do decide to get rid of the goal, post it for free on the classifieds here and it will be gone in a jiffy. If I had a truck, I'd be happy to come take care of it for the HOA.

@Sammee That's what I originally looked up when they tried telling me it was recently put there, but the maps had to be taken sometime early last summer cause I see my daughters play scape in the backyard. Also the graffiti on the culvert that some deviant kids tagged ( which I was told was supp to be taken off). On Principal alone - I want them to have to make the effort to remove ALL of them!! Even tho it's not mine to "sell" I'll talk to my neighbors and see if they are willing to put it in their driveway unlike me, and if they don't Ill personally drive it to you! 😄

Well even in the current pic I would think it shows its at least been there for about a year which CAM wanted to argue it's been placed there within the past month or two cause " if any longer a law suit would have already been filed". I told them that I could get at least 9 houses that would say its been there 3 plus years. (I've been here about 2.5) They said it wouldn't matter. They "made a note" and just said they would contact neighbors and if no one claimed it they would remove it.

@Tuckersmom I find it interesting that you suggest that as a parent you wouldn't want a kid walking too far without supervision, but you are okay with a group of kids chasing a ball in the middle of the street where they are subject to getting ran over? That is the issue here. It can legally be considered child endangerment by encouraging minors to perform an activity in an unsafe environment. I have read several posts that suggest that kids will be breaking into homes or doing other mischief if not allowed to play in the street. That sounds like passing the buck on parenting... when I was a kid we played ball in the driveway. And let's not kid ourselves into thinking that the kids in the street politely move out of the way every single time a car comes by. I understand that the annoyance of the situation but let's not kid ourselves into thinking anyone has the "right" to play in the street. For that matter, you even said that you DID NOT want all the kids in your driveway... so I am guessing you would rather have children playing in the street? That sounds like a bigger issue.

@OddThomas I wouldn't want the kids playing in my driveway. One falls & breaks a leg you're liable - homeowners ins. claim. Who needs it. It's not her goal so let the HOA take care of it. I've seen plenty of kids play in the road. Haven't heard of one getting hit by a car. @pksbar Mom, is that you? Lol. You are only liable if you, the homeowner, are aware of a clear danger and don't notify the people on your property of these dangers (hidden giant sinkhole in driveway, rusty nails all over driveway, chupakabra den on your property). Check with your insurance agent.

@Sammee That's funny b/c I had a neighbors kid fall on my property due to being a goof ball & klutz, broke her wrist & the parents filed a claim with my insurance company and my insurance company paid the medical bills. Nothing was wrong with the pavement she was on. It was quite a few years back & a different state, so I don't know if that makes a difference.
