I never said anything about those things. I was offering a point of view from another similar situation to demonstrate that HOAs all operate in a similar way. The issues you complained about *pertaining to this thread topic* are present in most nice HOAs because most residents in nice areas actually like these events and are willing to pay for them. The minority of people who don't want to see their funds pay for community events that they either don't attend or that outsiders could attend or both...are simply outvoted. HOA neighborhoods may not be a good fit for said individuals.

Well, it is always good to acknowledge the positive.... even if it is only the fact that the dead pine needles are gone and the grass growing over the curb was finally trimmed.
 
I don't follow too many of the other issues, but I bet the parade had more costs than just the hot dogs. There were 4 police officers escorting the parade and I assume they were paid. The parade was nice and my kids enjoyed being a part of it. I am thankful our community has this.
 
Did someone email a board member to ask about the pools? This could be a management issue for the company that does the staffing for the pools. Maybe too many people called in sick because they didn't want to work? This may not be the fault of the board members, but they should give you an answer if you ask.
 
I get irritated by a lot of things about the HOA, but I really worry when things seem so aggressive on the part of some community members and some board members. Please don't let your anger over some issues make you unable to see the positive things about our community. I hope you are not as sarcastic in real life as you where in your response to a stranger on a community message board.

It is my opinion KK saw to it that the Pinehurst Trails medians looked good BECAUSE HIS DEED RESTRICTION BREAKING SIGNS ARE ON THE MEDIAN & HE IS HAVING A FUNCTION AT ( HIS ) PLACE OF BUSINESS .And if not him this Board saw to it BECAUSE OF HIS FUNCTION & our parade, makes these medians more visible . HOW LONG have homeowners complained & now it ( JUST ) got done & looking good for his event & our parade .
 
There were 3 police cars that started the parade & 2 that ended the parade . Now our subdivision NEVER has more than 2 officers at a time . We have a total of 5 officers that we split the cost of with Walden but we do not have more than 2 at a time . Unless it is meeting night & JW & the rest of the Board want to THREATEN the home owners . I would need to ask a couple people but I think we had 3 maybe 4 at the last meeting . Of course JW's words TO ME WERE WE ARE NOT PAYING FOR THEM THEY ARE ( FREE )!!!!! This was said to me in the lobby of the O L that night because I complained about it . I mean these are officers that are suppose to be out riding around & being visible in an effort to deter crime . And where are they ??? Protecting our Board from answering questions !!!! If you ask a question many times you are told, I WILL NOT ANSWER THAT QUESTION, OR JW looks at someone else & says next question . If you ask it again & say please answer this question, you are warned , one more time & you will be taken out of here .If you ask again YOU ARE REMOVED !!! This Board does not feel it has to be responsible for( anything ) they do . They voted on stuff with a room full of homeowners that had no idea what they were voting on . Sent LL over to Water Board 132 to go get some more money for them to spend on our parks . In the mean time we had no idea this stuff was even in the works & they had already approved it to be done & I can only GUESS THEY RAN OUT OF MONEY THAT THEY FELT THEY COULD SPEND so LL went to go get some more money !!! So glad I'm not in WATER BOARD 132 . The only way we found out I just happened to look at the agenda on 132's website & saw LL did a presentation on the ACIA comprehensive plan in Feb of 2014 . A friend called I think 2 water board members who seemed surprised we did not know about this & both said it had been in the planning stage for a while . I spoke to one board member at a meeting & I believe 132 thought all of us were aware of all these plans . I don't think water Board 132 had any idea the ACIA Board had not told us all about this .Why would ACIA Board hide this ??? If they think this is all a good idea to spend this money why not stand up & be proud of all these good things you are doing ??? They must have thought this was all a good idea right ?
 
Please google & read Homeowners Prevails in Legal Action Against Board Of Directors for Breach Of Stautory Duties . in this it also describes ( FIDUCIARY DUTIES OF DIRECTORS ) . This is just 1 example of many that can be found of HOA boards that end up in court over the words FIDUCIARY DUTIES of Directors . So I think there are a bunch of HOA's out there with unhappy homeowners even though some try to make it look like just a few of us are unhappy campers & think we should move out of the neighborhood as one person has said . Spend some time on line & you will see we are not the only people with complaints .
 
Fiduciary Duty --A duty to act for someone else's benefit , while subordinating one's personal interest to that of the other person . It is the highest standard of duty implied by law ( e.g., trustee, guardian ) ' Blacks Law Dictionary
 
Upon their election to a condominium or homeowners association board , directors become fiduciaries , which means they are held to a higher standard of conduct . As fiduciaries , directors have 2 primary fiduciary duties ( 1) duty of care (2) duty of loyalty . This applies to directors of both incorporated & unincorporated associations .
 
Duty of Care ( Due Diligence) Directors must be diligent & careful in performing the duties they have undertaken . BURT V. IRVINE COMPANY
 
Duty Of Loyalty ( NO SELF -DEALING ) Directors must act in the best interest of the association EVEN IF AT THE EXPENSE OF THEIR OWN INTEREST !!!!
 
Are we asking to much of them when we ask them to answer a question ??? We have asked & asked & asked for our 2012 audit, it is July & we were told in our Jan 27,2014 minutes they just received & the Board will approve it at the Feb meeting . So 7 mos these folks have had this audit report in their hands . What is going on ??? Does anyone think this is just a little strange ? We are 5 mos away from 2015 & don't have 2012 or 2013 audit reports .
 
Oh, but yes many I'm certain will tell you how wonderful & what a good job this Board is doing . Although I would have no idea how they would determine that, unless they were party to all the emails & business conducted behind closed doors , & none of it discussed in front of us just $ amt & RATIFY RATIFY RATIFY & oh the COMMITTEE ( OR ) THE BOARD will decide on the price of the lots . What committee ???? To this day we have not been told about this committee & when you voted your trustees in to their position did you EVER FOR 1 MINUTE THINK THEY WOULD TURN OVER ( THEIR ) DUTIES TO SOME COMMITTEE !!!!
 
And people who don't go to meetings & don't know what is going on WANTS US TO BE POSITIVE now what a joke I find that to be .
 
Oh that Real Estate Listing Agreement in my opinion shows just how quite these folks were being about all this & I quote Broker will not file this listing agreement with a MULTIPLE LISTING SERVICE ( MLS ) OR ANY OTHER LISTING SERVICE . Then under 11 Brokers Authority says Seller DOES NOT WANT THIS LISTING TO BE DISPLAYED ON THE INTERNET !!!! So how many of you phoned a realtor to come & list your home & then told them now I do not want you to put this on the MLS or display it on the internet !!!
 
I wonder if anyone wonders if just maybe something is going on ???? Do you maybe wonder WHY CALL A REALTOR TO LIST & THEN NOT LET THEM ADVERTISE ???? Almost sounds like they already had an inside buyer & had no need to make this property available to all ??? Could that be ???? Are maybe they didn't want the people in Section 8 that back up to this property to know it was for sale ???? Oh can't be that, why of course they would want their own homeowners to have 1st option on this land right ???? Oh, that's right I forgot , these people had no idea this was for sale . So maybe someone can explain what part of all the above do YOU THINK IS POSITIVE ?????

I've lived in eagle springs for 11 years now. We pay crazy high dues, $850 a year. We have at least 6 or 8 events per year like the celebration mentioned in this thread. They are limited to ES residents...but it's not like anyone checks IDs. I am quite certain there are many party crashers who don't live here but partake. It is expensive and is included in our annual budget that results in our annual dues.
 
I rarely attend any of our events because they always conflict with the kids' sports stuff. How dare they not schedule them around my calendar! So my portion of the dues contribution goes to pay for other residents and (gasp) non-residents who do attend. It is what it is, I'm not crying.
 
My point is - nice neighborhoods with hOA dues and events and amenities all have problems like these, naysayers, and people who aren't happy about something. ES does too. Thankfully we don't have anyone with quite the level of negativity and tenacity as some.
 
Everyone can't and won't be happy. Some would be better off living without an HOA where things can be to their liking and everything can be within their own personal control.

When I moved to Pinehurst I understood( up front) At Walden you were forced to belong to the club over there. In atascocita it was a private business ,& required people to join if they would like to .I knew my association dues would pay lights, trash, up keep on 2 parks including 2 pools ,2 bathrooms & gym equipment on the play ground & 2 tennis courts & a marina & common area's .We had our own pool & none of us played tennis or golf or used the parks or marina. Which we knew ahead of time & was ok with us . I'm all for taking care of WHAT WE HAVE , & if WE have the money to upgrade & homeowners want to add new things I'm all for that . But these folks on this Board say they did a survey.& most wanted all these improvements . The only thing I heard them survey was replacing a fence, & everyone I spoke to said I voted no, & everyone I spoke to also voted no ,so how did they replace this ???And at the time of that survey there were only 400 something people signed up that could be reached through email . So out of 2500 homeowners 2100 knew nothing & didn't have a chance to vote .How do you say the majority wanted this ?
 
It is our money that pays for all this stuff & a VOTE BY MAIL should be taken to see what the PEOPLE want ( NOT 5 PEOPLE ) on the BOARD !!! Behind closed doors these people have spent a fortune & then went & asked Water Board 132 for more money.
 
The question was asked if you could add to our amenities what would you want ? I said if we had the money build a club house , parents could have birthday parties there & large family reunions & we could have HOA meetings there . I also said add a large fishing pier at the marina or upgrade the fences at the 2 pools .Now does that sound like I don't want to spend ( ANY MONEY ) ? I think what most of us want is FIX EVERYTHING WE HAVE before you do ANYTHING NEW !!! We have 1 tennis court in terrible condition that they have not touched , yet they want to add a very expensive jogging track & they want to add MORE SPRINKLERS to water some grass that in 50 yrs has never been watered . We have spent a FORTUNE on our sprinkler system , last thing we need is some more to up keep . In the 1990's we had a jogging track & tore it out because it was not used & the up keep was to expensive . You want to run ? hit the street & you can run all the way to New York !!! My youngest child has been gone for 22 yrs & we will use NONE OF THIS stuff but we are ok with doing new & fixing old . But do not raise the dues to do it because a lot out here will never agree to that . They are retired & many don't have the money .
 
What I expect is good workmanship on what we do, & I have not seen that over here & have proof with pictures . All the boards on the new fence were cut to short the entire thing is a MESS& I informed the Board the hangers they paid for at least 99% were not there .
 
The new fence at the Pinehurst pool all the metal inserts were COVERED with RUST . I watched them paint right over the rust . No sand blasting or sanding & primer of any kind .So how long you think this will last .
 
I think by law if you do any remodeling like our pool bathrooms it has to be ADA compliant . This Board was told that & went forward anyway. So a person in a wheel chair cannot go to any function at our park & be able to use the bathroom . But because WE complained about this LL has drawn in a concrete path leading to the jogging track . So I guess she figures these folks would enjoy speeding in their wheel chairs around the track or racing with a runner . She needs to advertise on our website & news letter if you are in a wheel chair & want to go to either of our parks PLEASE WEAR A DIAPER as I have already told other homeowners it is way to expensive to make the bathrooms ADA compliant !
 
Most of us want a quality product for the $$$$$ spent & a ( TINY ) bit of common sense & please do not turn your back on people in a wheel chair as this Board HAS DONE !!!!

Good example of a lie is to tell everyone because of a few we need police there. I believe a member Cheryltom has already said people taken out were not doing anything but asking questions .

With all respect to you, no one is asking you to answer any question on this forum. The complaint is that homeowners are not allowed to ask questions at the board meetings. If they ask questions, they are removed from the meeting by constables. With that kind of activity going on, I prefer to remain anonymous.

You lie !!!!! I have proof of the emails I sent this Board & NEVER GOT AN ANSWER OF ANY KIND AT ALL . I want them to show me their DATED PROOF through the emails they sent back to me . And you have gone to very very few meetings after John & Anthony got on the Board . And not only has this Board not answered some I DON"T KNOW I'M GUESSIG PERHAPS 5 emails JW has responded to others with ( THANKS ) Yep 1 word response THANKS ! So NO ANSWER NO OPINION JUST THANKS . And I sent a letter to Sterling certified mail &( by law) within a total of I think it is 15 days they( BY LAW) HAVE TO SEND ME THE STUFF I'M REQUESTING . If there is something I have requested for example 2012 audit & they have it but have not voted to approve it yet of course it can't be sent to me yet , they have to let me know that . They then say as soon as it is approved we will email it to you are you can come & get it . GET THIS ---- I GOT ( O) FROM STERLING I MEAN NOTHING . I HAVE MY COPIES OF THE LETTERS I SENT & PROOF OF WHEN THEY RECEIVED THEM . So why don't you go & read what the LAW SAYS. What have I twisted ??? I want you to put it out here & prove it because I have or friends have recordings of all meetings & I have proof of all emails & I Document every thing with pictures all over our subdivision . Every email you ever sent to my house I have .
 
I have written on here many times & any ( HONEST ) person understands that most of the time when I talk about something I tell the person to go to the Jan 2014 minutes & read it for yourself . Are I say to them start back in Jan 2014 & see if you can find in any of the minutes from then till now when this topic or that topic was discussed . What you will find there is no discussion on this subject yet before our very eyes they open a meeting & RATIFY 10 things $$$$$$$$$$ ! Every WORD I have spoken on A COM about ACIA ( I) have a copy of , do you RH ???? I have no reason what so ever to lie or twist anything .nor would I .
