This is my fence. Yes I am the infamous owner of the "horrible, ugly, dangerous" fence. We have no back yard, what do you people want!!??
The HOA approved it fair and square!!

People buy houses for all sorts of reasons. Some want big yards and some do not. Some want a pool and others don't. So when you buy a house you look to see if it meets your needs. My lot will never have a pool because you can't access the back yard to put one in. Some who buy on the golf course will never be able to build something closer than 25' from the back property line. Some lots are zero lots and have no side yard.
You get what you get when you buy a house on a lot. Your particular lot has no back yard because of the way the builder placed the house on that lot. However, that does not change what our deed restrictions states. No fence shall extend pass the builidng on said lot toward the front lot line. This lot is not a corner lot. Those lots are designated in the deed restritions and this lot is not one of those listed. This fence clearly breaks the deed restrictions and leaves several over homes in our subdivision to do the same. Houses and their placement on a lot is not what dictates fences. The deed restrictions dictate fence placement.
The ACC (before All the board removed them) denied this fence not once but twice. The next step would have been for the owner to appeal the ACC decision to the board, however, the next thing that happened was the fence was allowed to be built. When questioned, the new ACC first said they did not know who had given approval but the fence had been given a conditional approval. The next month when questioned again a member of the ACC said it was just an illusion that the fence was in the front yard but was actually the side yard. That is scary coming from a new ACC member and what other misinterpretations are yet to come.
This is what happens when ACC members do not know what the deed restrictions say and just go on what they think should be done. In a few years we will all look back and wonder what happened to this subdivision. As Kyle Adams, new ACC member stated, It won't matter, people will just get use to it. Don't you love the sign that the county came out and installed? What a nice addition to the street. Maybe Christmas lights will make that look nice too!
