Suspect Arrested for Criminal Trespass in School Parking Lot
SUSPECT ARRESTED FOR CRIMINAL TRESPASS!
On November 14, 2023, at 1:37a.m. deputies with Constable Mark Herman's Office were patrolling in the 18800 block of West Lake Houston Road when they observed a suspicious vehicle in the school parking lot.
Upon making contact, the vehicle owner was identified as Kylynn Muhammad, who was found to be in possession of a semi-automatic firearm and marijuana.
"Kylynn Muhammad was arrested and booked into the Harris County Jail, charged with Criminal Trespass. His bond was set at $100.00 out of County Court 6." - Constable Mark Herman
Thought a loaded gun on school property was a felony. The address is Atascocita Middle School.
@1ontheroadagain : It's a third-degree felony ... so I don't know what the heck they are thinking.

Parking Lots Parking lots on school grounds are an exception in Texas. According to U.S. LawShield, Texas legally defines "premises" as specific buildings or portions of a building. However, this definition doesn't include parking lots. Therefore, if you're a legal gun owner in Texas, you would be able to legally keep a concealed handgun in a vehicle that's in a school parking lot. However, the vehicle does need to be locked, and the gun has to be properly stored out of sight in the vehicle. This exception also applies to:
• Streets and sidewalks near schools • Publicly accessible walkways around a school • Parking garages on or near school property
