Houseguest Arrested After Panic Alarm Call

PCT 4 Deputies arrested a man after he engaged in an altercation with them over the weekend.

According to reports, on Sunday, November 12, 2017, deputies with Precinct 4 Constable Mark Herman’s Office responded to the 7400 block of Maple Walk Drive in Atascocita in reference to a Panic Alarm being set off.
 
Upon arriving, Deputies were met at the door by the homeowner and a guest. When Deputies entered the residence to investigate, the guest, later identified as Jordan Balciunas (33, North Hollywood CA), physically pushed the Deputies back. He then proceeded to grab one of their Tasers and attempt to take it from them.

“Jordan Balciunas was arrested and booked into the Harris County Jail, charged with Attempting to Disarm a Peace Officer and with Interfering with the Duties of a Public Servant.” ~Constable Mark Herman
 
Balciunas is in jail as of this release on a $1,000 bond.
 
Side note: Even though his address says he is from California, Balciunas has had previous encounters with law enforcement in Harris County dating back to 2005.

@AtascocitaDotCom Am I missing something? Who set off the alarm? Was the guy robbing the owner? Story seems to be missing something. Sounds circumspect.

Man this house owner was nice enough to just push the Alarm. That option wouldnt be the first thing in my mind to get someone out of my house.

@TheCatsMeow It is missing something, in fact a lot of something, this is my house that it happened at , right in my dining room , I own the home and he is a friend of myself and husbands, he was not breaking and entering , he didn’t attempt to rob anyone or put us in harm , he is a close friend that we have grown up with , the officer tried to come in my home and he spoke up for me and said they can’t come in unless they have a reason or warrant, the officer pushed him back and slammed him down in my dining room and tazed him , I screamed begging them to stop and why they did they never answered me till he was in the cop car , I have a video of it that I will obviously have to use , but that story is completely wrong . The officer got trigger happy and wanted to use it

Just to let you know that when alarms go off in a residence they are called to investigate and must determine if persons or property are in distress. What you should have done was call the alarm company to cancel the call to police and provide your secret code if yours does that and even if they arrive they have duty to determine your identity and those with you to make sure you are the lawful owners. Officers can make a warrantless search if there is reasonable facts that a crime is being committed and unfortunately in your case the alarm call is based on it. I have been in your situation with two false alarm calls at my residence with once I was at home and they came over as I happen to notice my dogs barking loud and knowing that they were looking at my residence I opened the door and greeted them with ID at hand. The second time involved my gardner who was servicing my lawns and unknown that another false alarm was sounded . Police came and immediately handcuffed him and his crew but I got on the phone and told them they work for me. I changed alarm companies after these two incidents but not once did I blame the officers. Your friend should've been more cooperative.

@cbp210 I actually did called the security company and they said seeing that the officers were already there and have him in the back of the car they can not change anything. It happened within a matter of seconds, when I turned to get my id with the door opened he was on the ground with a taser on him , even After they finally listened to my story over it all they said well he is getting arrested for evading arrest and now they changed it to disarming an officer, Interesting how they wanted to change it but yet didn’t mention anything about how he supposedly tried to grab the taser .

that is because your friends involved himself into a situation he should not have done. Cooperation is always the key to dealing with officers responding to alarm calls. Your friend intention may have been to protect your interest but he did make a big mistake by interfering.

Your missing the point. his presence was not the problem but his decision to escalate a situation that did not have to happen was. You knew an alarm went off and you were late to call them off with the security company so they had to make sure no crime is being committed. There job was to make sure everyone in house is legit and allright. Also for your second statement my wife has answered the door many times at night with a plan so I am confident in her.

PCT 4 stats reflect that within the ACIA area (1/2 of their assigned territory) they answer around 20-30 alarms each month. I have never seen a positive alarm recorded on the public stats yet in 4 years of following these months stats.
 
I assume there may be a difference between a alarm and a "panic" alarm - I don't know.
But should these officers enter every home they respond to ? Again if they record responding, I am assuming they got there before the owner had a chance to call.
 
Also as a realtor , i have sat off alarms before and without the owner present I simply waited for anyone to arrive. They did not barge in and taser me in any of these.
 
Still sound to me like someone was having a bad day .
