He's the one that stole the potato chips and the clerk followed him in a car.
 
Clerk messed up by pursing him...He was running away....Right then the clerk became a "lethal threat" to him and he had a right defend himself....Similar to a "shooting a person in the back" situation when they are fleeing in that they aren't a "lethal threat" anymore....
 
Question is....Will the teenager's family being filing the usual "Wrongful Death" Civil Lawsuit against the Clerk now that this court decision has been made?

No, he was not a lethal threat. The "kid" is a killer and I hope his next victim is his last. We cannot tolerate this sort of behavior from anyone.

My fear is this area gets overrun with people like this. Too many people around here that are tolerant for behavior like this. I see grown men walking the roadways everyday, panhanders on all the busy corners, drug use rampant in most of the neighborhoods. I keep saying hopefully things will stabilize and start getting better but I have been doubting that more each year. This use to be a very nice conservative area.

@Pinehurst : Maybe the police didn't do the best job with the investigation because it was presented to a grand jury. I'm shocked he wasn't charged but we don't know how it was investigated nor do we know how it was presented by the DA or Police during the grand jury.

No....But once there is a "pursuit", the situation completely changes....
 
BTW...I'm not taking up for the kid, just stating why the Grand Jury probably made the decision they did in this case....

Let me give you another "real life" example....
 
Back in the 80's I knew a guy who got into a heated argument with another guy who ended up pulling a gun on him during the confrontation....The guy I knew was also carrying a gun(revolver) and, obviously feeling threatened, pulled his gun out and shot the other guy, who fell to the ground....That was "self defense" right then and there....BUT then the guy I knew was **** off and had all the "adrenaline" flowing in him so he stood over the other guy as he lay on the ground and emptied the rest of the revolver's rounds into the other guy's head....THAT changed the whole thing and made it a "Murder" charge(or maybe Manslaughter, I can't remember) for which the guy I knew spent a few decades in Prison for....
