I want to give everyone a head's up that now that the golf course owners have lost the court battle, they are going to send letters to everyone trying to get at least 75% of the golf course lot owners to sign away the restriction.   Their letter threatens to shut down the golf course if you don't sign.  It also makes grand promises of keeping the golf course open (forever I guess) if you do sign.   It claims to not affect many.   I've done my part and I have won the court battle.  It's up to each homeowner to decide if they trust these promises.   Don't forget, they are required by court order to continue to maintain the property forever, whether they're running it as a golf course or not, so don't let them threaten you that it's going to become overgrown if you don't sign!
 
Bottom line: Do not sign.

Treat this like any other contract you would sign: What are you getting out of this agreement? You already have the restriction and a court order that they maintain the property, so think about how this would benefit you if you agreed to release the restriction and gave them all the power to do whatever they want to do on that property.

Is this for the entire course or just the 9 holes adjacent to 1960 (The Pointe)?

@bjfleming2357 : Thank you for posting. Where did you originally see this info? I am a Pinehurst homeowner and haven't been receiving any communication regarding this issue, even though I am signed up for emails.

@Sammee : There is a Facebook group: Atascocita CG Owners. Posted by the lawyer: Kimberly Spurlock, who defended the property owners living on the golf course rights to keep the golf course and not turn it into whatever the club owners wished. ie: condos, apartments, etc.

@eighteen : I believe my friend said it was for 75 homes that are around the golf course. If they did it, there were be some extra homes/apartments? on 1960. It would be nice if they would put a nice restaurant like in the old days for Sunday brunch, etc.

@eighteen : It sure affects the entire neighborhood, but it looks like the FB group was just for the golf course adjacent homeowners. There has been zero communication with the rest of the neighborhood, which disappoints me.

@bjfleming2357 : So if you sign it and release the restriction they can do whatever they want with the property, if you refuse they either have to keep it a golf course and open or close it down but keep it maintained? That sound like a no brainer not to sign it.

@Sammee : I think it is only the golf course home owners have a vote. Their threat is they will close the course. That will bring our values down. My house is on a lot and half that was supposed to be golf course and it isn't in the vote.

@ladybeachbum : I understand that I wouldn't have a vote, but this affects the entire neighborhood. We have the right as homeowners in the affected area to know the current status. A simple mass email would take all of 2 minutes to send and doesn't cost a dime. They already have our email addresses. Emoticon

i think that would be a fantastic area to develop for multi level section 8 housing .. the exit and entrance could easily be flowed out on rebawood or 17th green

@Sammee : This is a vote for the owners of property on the golf course. We have already had a vote by all the ACIA owners and it was a NO vote to get involved by a great majority.
