This is a very strange case and I and some of my coworkers have been following up.

Random tidbits from another article:

Smith is a retired security engineer for the U.S. Department of State. Kifer and Brady were cousins. The two were well-known in the community, and both were involved in sports.

Court documents from another case show Brady had burglarized Smith's property at least twice in the months before he was killed.

At first I thought the 1st degree murder charge was an extreme reach even though the shooting did seem excessive and I was weirded out by how fast he had a tarp ready. But now knowing he waited a day to call it in and after reading his own statements in the above link it sounds like the guy has been waiting for them to show up for his revenge and needs to see some jail time.

But I have to say I'm still slightly torn over this. This kid already burglarized this guy twice and he was stupid enough to do it again. He was the cause of this guy's action. If he would have stopped the "game" he was playing he and his cousin would still be alive.

@daddyo9:

This is what makes this story strange and difficult. I can say in California he would be convicted with no hesitation.

it bothers me how they show those two kids... smiling, as if they were two angels, where in reality they were up-to-no-good... I understand the girl had a history with drugs and was intoxicated the night she died... and were repeat intruders in that house... ok, so they weren't Bonnie & Clyde either, but hey, you start behaving like a criminal, well, you may die like one...

but, the homeowner was just plain stupid here... recording the whole thing, and saying "you're dead" before the "executing" her, etc. Nothing wrong with protecting your life and your property, but when those kids were no longer a threat, he needed to stop... now he's paying the consequences...

For some strange reason there is something wrong with that guy. I would hate to be his lawyer.
