Hearing to determine whether AJ Armstrong will get 4th trial wraps for day, judge to decide

HOUSTON, Texas (KTRK) -- AJ Armstrong returned to court on Tuesday, asking a judge for a fourth trial.

Armstrong was just 16 years old when his parents were both shot to death in their bedroom in 2016. It was a horrifying crime that kicked off a seven-year saga through the legal system.

After two mistrials, Armstrong was convicted of capital murder in 2023 for killing his parents, Dawn and Antonio Sr., in 2016.

An appeals court ruled in September that he was entitled to a hearing to determine whether a new trial was necessary because of a complaint filed against witness and forensic expert Sgt. Rossi that was not disclosed to the defense.

Civil Rights Attorney Randall Kallinen told news crews on Tuesday that the complaint that the expert DNA witness may have planted evidence in a previous murder trial was not given to the defense.

"I received the complaint to the forensic board on Aug. 17, 2023. It came in after the jury verdict," he said.

He told the court he would have prepared a different defense strategy if he had known about the complaint.

Armstrong's trial defense attorney Rick De Toto took the stand on Tuesday, as did co-counsel for the state on the case, Ryan Trask and John Jordan.

Both Trask and Jordan said they didn't learn about the dismissed complaint against Rossi until the 2024 guilty verdict.

Both the defense and the state closed their hearing arguments on Tuesday. Judge Kelli Johnson, who will make the decision on whether Armstrong will get a fourth trial, broke the hearing for the day. The hearing will reconvene at 8:30 a.m. on Wednesday.

Correct me if I'm wrong, but did they ever explain how the alarm was never turned off yet someone could have got in and out of the house? If they did I missed it. 🤨🤔
