From an insurance standpoint, if a neighbor's tree falls on your property, they're responsible only if the tree was already dead or damaged.

Well Lynnsgirl & some others made me question ((who is really responsible)) . When I went on line I'm convinced WE are responsible . The top of that tree breaking off was an act of God through a rain storm . It's not like they went outside & did something or neglected to do something that they should have done but didn't . So tomorrow we will see if our insurance company thinks it's our responsibility are not . I think it is & I don't want her to have to come to us & tell us oh I'm so sorry but our tree in your yard is your problem . Their a young little couple & I know that would be hard for them to do . And besides remember I believed it was their tree & their responsibility & I knew from the location of where it fell they couldn't see it from inside their house . So I already let them know their tree fell in our yard . So soon as we talk to our Insurance co I'll get in touch with them . Thanks for opening my eyes Lynnsgirl & a few others .

@bbk : I learned this rule the hard way I paid for damages due to neighbors tree but act of Mother Nature made me responsible!It's a quirky one for sure!

Well I guess if you can trim your neighbors tree branches that hang into your yard then you can be responsible for damages caused if that same tree fell in your yard and did damage. This is eye opening as my backyard neighbors tree is always dropping huge branches into my yard. I will be interested to hear the outcome too!

I thought if mother nature dropped the tree, then each homeowner is responsible for their own damages. So, if it damaged the fence then each home owner would pay for half.
