Atascocita South trash bill is now doubled. $252 extra might be used for future 'projects', Says the HOA. This is in addition to raising our HOA fees by the maximum 5%. I just payed my MUD152 water bill and the newly applied charge of $21 a month for trash service. I also paid my HOA fees which included fees for trash service. The HOA approved their 2026 budget before agreeing to let MUD 152 take over trash service. Did they then decrease what needed to be paid? No. When I called the HOA they agreed we were being charged twice, but since the budget was approved before the contract was signed they will not lower our fees. Can they charge us the 5% maximum allowed increase and take our money for services they no longer provide? Seems wrong to me. They said they will look at the situation in late 2026 when they approve next year's budget, but admitted if they need that money to pay for future projects they may not lower our assessment fee then either.

I wish I could withhold payment, but they could put a lien on my house. The HOA company said they had their lawyers look at everything and there is nothing we can do. I checked the by laws, deed restrictions, etc. and I can't find any loopholes to help me out either.

You are absolutely correct. The HOA company pretty much admitted that to me on the phone. In addition, I can't find any loopholes in the contracts that will help me out. I checked the by-laws, deed restrictions, etc.

That is why I'm causing a stink now. The HOA invited homeowners to come to the January meeting to discuss the trash issue and no one showed up. No one showed up during the February meeting either and I can't get anyone else to come to the March meeting.

There is a document called Covenants, conditions, and redrictions. It may be on the HOA portal online. If not, once you start searching online it will take you to a lot of interesting places. There are usually limitations that HOAs can't just do whatever they want. Other states don't allow "possible future projects" but we live in Texas so it's government plus 1 and consumers -0-.
