I thought that by definition, murder was intentionally killing a person. Unless I'm missing something, this doesn't sound like murder.

Two thoughts:
1) There are various degrees of murder - 1st degree, 2nd degree, etc.
2) Googling 2nd degree murder, I find that you can be charged with second degree murder if there is "reckless conduct lacking concern for human life". I would suspect that this is the law they are using.

That's horrible. Don't like blaming the victims but being out in a golf cart at 3 isn't a great choice. We rarely ride I'm ours at might even though it has lights and a reflective triangle on it..

West-Tex : The golf carts aren't allowed to be driven at night only during the day. So I wonder if that's going to have any affect on the trial

Maxsmom : I would hope not. Driving a golf cart at 3 AM is incredibly stupid and you may be asking for trouble. BUT . . . he was drunk and hit and killed three people. Would hate to think that driving at the wrong time could provide any shelter from facing the severity of what you did.

Very sad indeed. But I'm reminded of the female teen who was driving drunk about 10 years ago, she crashed, and her passenger boyfriend was killed. She served no jail time. Why is what this guy did so much worse. Oh yeah, I forgot, the girls dad was a judge in Houston.

Maxsmom : my daughter lives a block away from where it happened. the day before on saturday afternoon we were turning into her street and a gold cart with a man woman and child just drove right in front of us never looked to see if anyone was turning. it was daylight and we just happened to spot them or we might have hit them. those golf carts are a big problem out there

Maxsmom : There are times I just want to go to my fav Mexican place and have some food and a margarita BUT I don't because they make mine strong and I just would never take a chance.

The very first thing I thought, after feeling great sadness for the three people killed, was what on earth were any of these people doing out at 3 AM?
Being in a golf cart eliminates the possibility of an emergency. The drunk driver has NO excuse for being behind the wheel.

Reese : Right. And golf carts in that subdivision are allowed but only during the day. And I'm not taking up for the drunk guy at all. He's 21 years old. He was almost double the limit . I feel so bad for those families that lost, their husbands or sons or brothers. This affects so many .
