AMCLady : You couldn't be lucky enough to have them getting people in line on your street. That would be too much to ask for.

Catmae : Lord, don't even get me started about my street. Today my neighbor has decided to park his two cars on his front lawn. Why not? Who's going to send him a letter?

JoeC15 : Yes it does. I also have neighbors who have trailers who have sat in the driveway for years. There are also boats sitting in the driveways on my street. My neighbor does not trim his lawn either. He thinks getting out on his riding lawn mower is taking care of the grass. In the meantime he has vines and grass growing up his house. Same with the mailbox. The driveway is so cracked that's more grass than cement. This is in Pinehurst. And no one has done anything about it for years. That's why it was a section 8 house for a while. Nobody wanted to buy the house. Now that we don't have a management company, who's going to enforced deed restrictions? Thank God the house with the chickens, geese, rabbits, ducks, five cats four dogs, and sometimes a donkey and some horses have moved. Rumor has it they moved over to the other side of Pinehurst. Oh, the neighbors are going to have fun over there.

AMCLady : That's over here, and I've yet to see or hear anything! And I don't know, we get letters if there's one blade of grass hanging over the curb.

Vinbert : I'm guessing you live on the west side of Pinehurst. I live on the east side of Pinehurst off of Atascocita Shores. If you're all getting letters over there, what are these people getting over here who have trailers either driveways all the time, never trim their yards, farm animals for years in and outside their houses, park on the grass in the front yard, etc. get in their mailboxes? Either the letters are ignored or they don't get letters and my street is ignored.

AMCLady : I'm willing to bet they're getting the letters. It's just the trashy people who ignore them. Ultimately, they know there's nothing the HOA can really do to enforce compliance. I don't get it....everyone wants to move up and improve their lives, yet there are those no-HOA-is-going-to-tell-me-what-I-can-do-with-my-property people that continue to live like they did from wherever they came from and trash up a nice area. Heck, we have a prominent longtime business owner who bragged about throwing away his multiple violation letters.

Sammee : Yes, that's been going on for the last 10 or 15 years. My street used to be a beautiful street but it seems like a different breed of people have moved in and they just trashed the place with their junk. Why are we paying maintenance fees when nothing's maintained. I don't see a cop around until something bad happens and trash pickup is a different bill. Yes we have pools in which I don't see many people swimming. But is that what I'm paying $650 a year for? I don't even go to the pool anymore. It seems the board since the money and what they personally want The hell with everybody else. And I sure don't care about how our lawns are maintained. I still have a house on my street that lives in the woods. Go figure.

AMCLady : But, what can the HOA really do to enforce compliance? They can't afford to take legal action against all of the violators. Our dues would have to be sky-high to pay all of those legal costs. They can't restrict who buys a house based on if they look like they may violate deed restrictions. I wish they could forbid rental homes, but they can't. The majority of renters don't care because they know they'll be moving on, and the rental owners don't want to cut into their profits by using money for improvements. All the HOA can really do is continue to send letters and hope that the homeowner gains some small sense of pride and common decency.

Sammee : I've heard all this before about how our HOA can't do anything about the homeowners. However, could you please tell me how it is the people in Kingwood are so scared of the HOA that they get letters about a blade of grass over the curb and they panic. I have visited their homes and heard about how scared they are of their HOA. I bet the enforced the rules. We don't.

Sammee: they could issue fines and then sue for collection or place a lien.
