Got hit by a drunk driver last Saturday night
 
Saturday night heading over to a friends house to watch the Texans game, sitting at the light in front of The Catch and a lady slams into our SUV. I got out to see if she was OK, and she was drunker than cooter brown, the damage wasn't that bad , I asked for her license and insurance. A wrecker driver pulls up and asks if everything was OK. She handed me the insurance card but it was expired and she refuses to give me her license so I asked the wrecker driver to call the police. The women jumps into her car and takes off. She pulls up to the light almost hitting another car and waits for the light to turn green and she turns into Atascocita South subdivision. I had taken a pic of the license plate, and gave it to the officer when he got there. The wrecker driver followed the lady into the neighborhood but lost her.
She had insurance but the car was registered in Houston and no idea who was driving, cuz it was in a mans name.
 
I now wish I had reached in and taken the keys out of her ignition and waited on the police to get her.

That is horrible. What is it with people driving drunk. If they know they are going to drink and can not handle it, they should stay home and drink or have a designated driver.
I don't like it.
I don't like people texting or on the phone while driving either.

What does the law have to say about restraining someone that just hit you? Could you have held her down or otherwise physically restrained her from fleeing the scene of an accident until the police arrived?

That sucks. Since you have the licence plate, insurance info, and witness to the hit and run can you still file against their insurance?

Oh yeah, we already did. About $2000 in damage, the Insurance was Geico, they filed a claim with them and they are investigating to see who was driving . If not I have uninsured motorist insurance and my deductible would only be $250...

That's awful! She won't get a DUI now (what a shame), but they should be able to charge her with leaving the scene of an accident if they can determine who she is. I would stay on the police as much as possible...regardless of who was driving the car, the insurance on the car itself is the responsible party, unless they determine the driver (if they identify her) was specifically excluded from the policy, I think.

sorry about this, you did all you can do. Just stay vigilant with the police and her insurance. Just know you have neighbors sending good vibes for a quick resolution to all this.

It seems to me that the police could go to the house and ask the driver which female drove his vehicle on that day, then take her photo for you to ID in a photo lineup. How hard is that? Unless the vehicle owner is a lying douche...
