Understood. Though a financial argument could be made in terms of the lawsuits that paid out to released persons, i think it takes away from the fact that these are people's lives that are destroyed. To make it a financial argument would be to assign these folks as collateral damage of imperfect system but every now and then, we get it wrong. The only problem with that, it could be you or I or a loved one who pays that price. Clearly in this situation, a man paid 27 years of his life but there are others who are paying the ultimate price. I don't think that can be captured in the bottom line of a financial statement.

I agree the financial aspect is what makes the death Penalty unattractive but feel this is a kink that needs to be fixed through the legislation and not the courts. If a person is found guilty and sentenced to death based on beyond a reasonable doubt for example confessions, caught in the act or other hard evidence then yes let's not waste time. I agree there have been instances were persons were sentenced to death based on preponderance of evidence meaning circumstancial evidence was used to convict the person and that is wrong. I still believe in the death penalty aspect of our criminal justice system and incidents like what happened to Randy Ertman daughter and her friend in 1993 supports my decision.

So, the guy wasn't on death row therefore this has nothing to do with the death penalty, but following your logic we should just do away with the entire penal system to avoid imprisoning one innocent person? Sorry for that single innocent person, but 99.99% (*) of people in jail belong there...
