This is an interesting case from Minnesota. Essentially a man killed two teens after they broke into his home. But he's on trial for murder based upon the actions he took in doing so. Here are two links. The second link is an actual transcript of a tape jurors heard as he talks to the teens while killing them. What's your take on this?

@Dragonlovermom:

I think the murder charge is accurate here. First and foremost the teens should not have broken into his home. This man had been burglarized previously (perhaps not by them) and he was tired of it. When he heard the glass break and subsequently confronted the first kid (Nick) I have no problem with him shooting him. Had he killed him with the first blast that would have been fine as far as I'm concerned. The issue for me comes with the second shot because Nick was no longer a continuing threat.

In regards to the female the same thing applies. Have no problem with shooting her either. However she did not initially die. According to the transcript he tells her she's going to die and calls her a *****, then he blast her again.

In my view there's a difference between killing to protect ones home and vengeance. This crossed into vengeance.

I agree. This seems to be more of an ambush on his part.

The tone in the transcript does not "sound" like a person in fear of their life.

Is this an old story and the trial is just now taking place?

I dont know the TRUTH in this story, but I will say this, the only time an intruder is no longer a threat is when they've stopped breathing

Strange. He waited until the next day and asked his neighbor to call the cops.

Said his Thanksgiving was already screwed up and he did not want to screw up anyone else's Thanksgiving by calling the cops the day it happened. He had also moved the bodies.

@Undecided: I heard he moved the bodies, but I didn't hear he waited till the next day to call the cops. Who does that???

I know, right?

I realize burglars and thieves do not exclude people like this from their list of potential victims, but I can see areas of concern. Would love to know if he knew these kids. Hope the truth prevails.

Sounds to me the murder charges are justified...

A threat stops been a threat when one of these three -ability, means and opportunity- aren't present.

Seems like this guy successfully stopped the threats... but doesn't mean he can just finish them off

I'm fine with the murder charge -- It would seem he was a little past defending his abode.

Random tidbits from another article:

Smith is a retired security engineer for the U.S. Department of State. Kifer and Brady were cousins. The two were well-known in the community, and both were involved in sports.

Court documents from another case show Brady had burglarized Smith's property at least twice in the months before he was killed.

I think the homeowner is a little mentally ill, however I don't think he should be charged with murder. Failure to report discharge of a firearm for sure, but not murder.
